In the last few hours of the Trump Administration, the Environmental Protection Agency granted two small refinery exemptions from fulfilling their requirements for renewable fuels under the Renewable Fuels Standard. The waivers add up to 150 million gallons of biofuel demand and the biofuels industry is not happy. The exemptions were met immediately by threats of legal challenges by the Renewable Fuels Association, whose leaders say they “sabotage the ethanol industry’s recovery from the COVID pandemic.” The news comes just days after the Supreme Court agreed to review a lawsuit over prior similar waivers in 2019 and 2020.
